Some guy is trying to sell POD prints of my speedster on ebay right now. I don't recall giving him permission to do that?
For whatever good it will you can report him to Ebay.

What are "POD" prints? You can contact eBay and ask them to have the seller cease and desist.
The courts rule consistently that any photograph taken in public or within public view is the property of the photographer. If you take a photograph of a person or object in public, you do not need a release from this person. In public, one cannot expect any degree of privacy. I once had a car I owned put on a T-shirt, and I saw it sold at a swapmeet. That being said, email the seller and demand royalties for laughs and giggles.
Ed, over the years, I have learned that what the courts rule and what eBay allows or doesn't allow aren't necessarily the same - and often aren't.
I sent him a message and reported it to ebay. Doubt they will do anything to stop him.

I told him it was my car,I built it. Only thing he has done is to photo crop off my front License plate.
If the car is in you own building you can ask or demand that nobody takes any pictures.
If the car is out in public you can not do anything about folks taking pictures.
And it doesn't matter if it is in a car show or just driving down the street.
It is the same as if you go to a dance and walk up beside a lady and touch her on the arm and ask her to dance-she can NOT holler sexual harrasment because she is at a dance. When you go there you should know what to expect.
If you don't want your car's picture taken don't take it out in public.
There is a word for it but I can not think of what it is. It is something like common agreement. Or maybe it is "mutual agreement".
Someone has pictures of my Autocar and my Chalmers Detroit for sale on ebay too but since they were taken at Hershey it seems like they are fair game. I would actually like copies of them but I can't see paying someone else for pictures of my cars!
Again, taking pictures in public isn't at issue here, what is at issue is whether or not eBay will allow pics of his car to be sold. Ebay rules don't always jive with laws. Ebay is a private company and they can say what can be sold or not sold. I'm not saying they'll back Jack up on this, but it doesn't hurt to ask.
I've had a couple of things pulled by eBay that were otherwise legal to sell anywhere else. Most notably, is a hand written and signed letter to me from Charles Manson. I tried selling it on eBay and eBay pulled it. Against their rules.
(And for the curious, the letter was the result of a contest amongst my friends and I when I was in college to see who could garner a response from the dude. I was the only one who got one.)
Val, write the guy an email and just ask if he would send you the pictures of your car.
He may just do it to avoid you getting on his case.
The seller removed it from ebay.

Just goes to show that it does not hurt to ask.
Really I could see where it could get into a gray area. If you car was stock and essentially just a restored car as it left the factory, you would not have a leg to stand on. Anyone could take a photo of it and do anything with it. However, the more your car becomes a unique "work of art", then the more rights you have. Just as it is illegal for someone to take a photo of a privately owned sculpture or painting and sell that photo, it could very well get to the point where someone could not take a photo of a customized car and sell those prints.
Of course those gray areas are what keeps the legal system in business.

If others thought my Model T was so nice that they would want to take a photo and share it with others, making a few bucks in the process, I would be flattered. Of course if I could benefit as well, instead of demanding that he cease and desist, I would ask that he split the proceeds with me and perhaps, after sprucing the old girl up with a wax and shine, take and post some nice, professional quality, multi-view pictures of my own, since it has been established that there is a market demand out there that needs to be met. I think Jim has it right, Take your own pictures, post them on Ebay for half the asking price of the other guy. Basic free enterprise!
Harsh Jack he'll just find a pic of another nice car and no one will see your handiwork. Now I guess my kids can't have a lemonade stand cuz someone else grew the lemons. Right on John and the act is called "admiration" by law it's called "Public Domain"

I don't have one I can(know how) to scan/post. He admitted he took it at Richmond,and I didn't object to that. I just didn't feel he should be making money off of my labor.

The only place I know of where it's uncool (but still not against the law)to take pictures is the nude beach.....the irony is we had a picture probably taken by a pro and now....guess thats why we have professional photographers they know how to take nice pictures upload them etc. I guess at the next car show yours will be the one under the tarp?
