Yesterday I had a customer call up and said he will be in my area on Monday and wants to pick up a wheel he bought, I asked when he bought it and I think he said Sep.18 - 2018
I kind of remember putting a sold tag on one with a name but no phone number, in the mean time we had some flooding issues and moved a lot of parts next door, after clean up we moved everything back, but now I look and can not find it, I told him this and he is asking for a refund, question is. have no record of the sale, it was sold on line or on the forum and he is looking for the paper with cost, do you think he should have called before this, I think 2 1/2 years is a bit long

I'll agree, you have been fair with me, finding parts I needed.

If you don't have record of sale, then maybe no transaction, maybe the buyer only asked to have it set aside and thought he paid for it.

And yes, 2 1/2 years is a long time, buyer dropped the ball or had valid reason. Reminds me of a friend who saw a Farmall on the side of the road out west, asked if for sale, bought it, but didn't get it on the spot. When he traveled back out west a few years later, found the place, but the tractor was gone. Buyer lucked out.

As they say, 'stuff' happens.

90 DAYS

If someone wants me to hold something I tell them I will hold it for 90 days and after that it is going back on the market. They will need to provide me with a proof of purchase just like any retail store for a refund. I lost other sales to other people who have called just after a buyer said they would take it and it sits here and sits here waiting. So it's 90 days for me.

I know someone like that, says he will buy or pickup if free. Then time (sometimes years) goes by and he expects the person to still have it when HE gets around to it with no contact in between!

2 1/2 years with no contact and no paperwork is way beyond reasonable. I don't see how anyone could expect that you would still have it. If he took it to small claims court he would be laughed out the door. If he gets on the forum and complains, a similar outcome. I understand you want to do the right thing but that requires proper behavior from both buyer and seller, and he clearly didn't hold up his end.

Not sure if "sold" also means "paid for". In any case, for someone to expect a seller to hold an item 2-1/2 years without contacting them in the interim is a bit of a stretch. There are many possible reasons for them not being able to pick up the item but there is no excuse for them not having contacted you in the interim, especially if they had paid for it.
If I were the Buyer? I would be a bit embarrassed to complain about the purchase conditions via the forum.

P.S. I would like to pick up the Speedster I bought from you on 3/2/2020 (or was 2/3/2020), some time next week. Okay?

I agree with Perry. Anything beyond 90 days is unreasonable. I'd tell the guy that the fee for storing his wheel is equal to the price that he paid for it.

I tried searching the 2018 MTFCA for any available info that might help resolve. Unfortunately it looks like only "FORM' discussions were saved/findable. Could not find anything on Parts or Vehicles for sale prior to going on the new MTFCA site.

I'd suggest you ask him for some paper work to support his claim. I agree, 2 1/2 years is a long time.

If he paid by PayPal, there will be a record. If he paid by check, there will be a cancelled check as a record. If he paid by cash, you would have given him a receipt as proof of cash received. If he can provide proof of purchase with any of these forms and you cannot give him his item, he should get a full refund. If he cannot and you cannot remember receiving any compensation, you owe him nothing. If he expects you to store an item for 2 1/2 years, he should be expected to retain proof of purchase to present to you upon pickup, just like a laundering service, jewelry repair shop, pawn shop, or appliance repair shop. Those businesses cannot release an item without the receipt or they could get into trouble if they give an item to someone and it turns out to be the wrong person. There are exceptions to this if the business owner knows the person, but rarely will a business owner keep an item for over 90 days, much less 912 days. This is precisely because of what happened to you.

Let him sue you and let a judge decide. You probably won’t have to say a thing. If he has no proof of purchase, he has no case and you don’t need customers or people like that in your life. Don’t lose sleep over it. Jim Patrick

All resolved, he came and had the copy of the money order and I honored it with some parts, but what he bought was long lost or gone, we discussed and I mentioned if you buy leave phone number and there is a time limit, he also bought some good used items, Bob

I applaud you for being gentleman ,to me that speaks volumes about character, which resulted in favorable outcome for both you and buyer,
Unfortunately I did not experience the same gentlemanly attitude with another form individual .e mail for additional discussion !!!

Bob has always treated me well and it is always fun to walk through his place. Lot of neat stuff to see.
